It is not illegal in the US. It is merely prohibited to sell it within the US. You can buy it without problem from a country where it is not prohibited to sell. See here:

It contains a mild toxin that acts as a hallucinogen, and the alcohol content is so high, it really screws with your head. People go crazy on absinthe more than on other forms of alcohol. I've drank it in Germany. I know. Oh, it is made of Wormwood.

I think it is all part of an environmental movement if we the US allowed Absinthe then all the wormwood trees would be destroyed to produce it. That and a little hysteria about seeing things when you drink it.

Not positive, but I think because it contains wormwood (artemesia), which is poison in moderate to large doses.
