No! It is legal for them to tell you you cant use it or else you are fired, but they are not allowed to take your cell from you.

However, if an employer acts that drastically, there could be a problem in the emplyer/employee relationship. That is called confiscation and usually occurs during conflict.

You may, though, work for a company that insists calls made in their place of business be monitored.(only their phones to be used). The reason might be the confidential nature of the work or business secrets or client lists.
There are many legitimate reasons that an employer might have. You haven't given the whole story.

An employer as all the rights to refuse you to use your cell while at work and if it could cause some kind of safty problem, they have the right to ban cell phones on the premisses if needed. In some jobs working with explosives, cell phones can ignite an explosive easily. So since that one employer has the right to ban cells, any employer does.

It's not really legal. the boss only want u 2 do it right. when u talk on the cell phone u might do something wrong. He could fire u 4 just talking on the phone

They hold your cell phone while you're working? Yes it's legal. They don't pay you to make personal calls. Just leave your cell in the car.

8 hrs work for 8 hrs pay. No cellphone use rules are the norm for many establishments now. Just as they have rules banning guns or other weapons in the workplace many also ban cellphones in the workplace. They usually provide a locker for you to store it in. Emplyees check for messages during break or lunch.

They have to give you a choice, give them the cell phone or get fired. No one can make you give up your cel phone, or even work, you are not a slave, you can do anything you want. But they don't have to employ you either, that is their choice.

DEpends on the work some sensitive work environments-military, intelligence agencies, prisons have every right to search and confiscate. In Texas prisons it is illegal to bring a cellphone into the prison.

If you are using it during working ours, yes they can hold it until you get off your shift and can claim it. It's best to leave it in your purse shut off, your locker, or your car. They are paying you to work, not chat on the cell.

Not just no, but HELL NO!!!!!!!! They can however ask you not to use it when you on the clock( some companies have a no cell phone while on the clock rule) !!!!
