from then on, she didn't like me. (How Immature)! I was layed off from that position due to downsizing and since I've been looking for a new job, the employers are calling my previous job for references and she is the one answering the phone.. she tells them that I have an attitude and never really wanted to work. This is not true! Isn't there legal issues here as far a deffamation of character. I can't get a job because she's been talking crap! I know there's some kind of laws. HELP!

Unless she's HR, she can't be doing that. She doesn't have the authority to tell your potential employer anything about you, unless she has that referral position. I would contact your previous employer and tell them what's going on. Unless she is authorized to be giving out references for that office, she legally cannot be doing so and can be fired.

FOr the most part, the only questions the new employer usually asks are

1. did this person work there?

2. Would you re-hire them?

Both are yes/no questions. They are not supposed to go into specifics. Ask the potential employer if they will tell you if she does do this. Explain the reason why and maybe they can help you out.

chicyuna is right, unless she works in Human Resources she cannot speak to anyone about references about you. I would definitely call your previous employer and take it with the boss. After all you won't be returning there any more right??

Ask potential employers to speak to a specific person. Tell them Mr. Jones was my immediate supervisor or is the head of HR so he can best speak to my experience there.

she's not allowed to say anything but yes that you worked there and for how long and if she would rehire you
i would put a different phone # and name

there are companies that you can hire to check what your references are saying about you . . .if they say something illegal, you can sue . . . apparently this is a growth area for lawsuits.
