WE HAVE A GERMAN SHEPARD RIGHT NEXT DOOR TO US, HE HAS ALREADY ATTACKED MY CATS TWICE, AND GONE AFTER MY 3 YEAR OLD SON. LUCKILY I GOT HIM OUT OF HARMS WAY. IT CLEARLY STATES IN THE HOA RULES THAT NO INTIMIDATING BREEDS ARE ALLOWED, PET MUST BE ON A LEASH, AND CANNOT BE OVER 40 POUNDS. HE IS NEVER ON A LEASH WHICH IS WHY HE HAS BEEN FREELY CHASING MY CAT AND SON. I HAVE CALLED THE POLICE AND ANIMAL CARE AND CONTROL. THE POLICE KEEP TELLING THERE'S NOTHING THEY CAN DO UNLESS THEY SEE FOR THEMSELVES THE DOG WITHOUT A LEASH, ANIMAL CARE AND CONTROL KEEPS GIVING HIM WARNINGS. NOW THE DOG OWNER HAS BEGAN TO THREATEN ME AND MY HUSBAND ON A DAILY BASIS BY MAKING GESTURES OUT HIS WINDOW AND CALIING US NAMES. WHAT CAN WE DO??? I AM JUST TRING TO KEEP MY FAMILY SAFE.

i am not an animal hater, the dog owner told me when he first moved in not to trust the dog. i have tried talking with the owner and ended up having to get a restraining order against him, because he started threatning me and my family.

You can get a lawyer and sue the Housing Authority for not doing what they are supposed to do.

Take pictures of the dog, and the owner together at thier house, (outside of course), running loose, and a couple of pictures of him chasing your cats, and that will be all the proof you need! (If you can, have the pictures with the date on them, and take them at different weather conditions, like a sunny day, cloudy day, rainy day or when ever...morning and near night... so that they know there is a pattern).

Then, take it to the Prosecuting Attorney in your City, if the Housing Authority wont do anything about it...

I wish you well..

What are the rules on cats and children? How are gestures through a window "threats"? German Shepards are not an "intimidating" breed of dog. They are generally friendly and happy animals. Perhaps you should try talking to your neighbor about the problem and what the dog is doing to your family.

Ever hear of building a fence? That would QUICKLY solve the problem.

Shepards are generally not viscious animals. It sounds like you are over-reacting and not responding properly, which would be to talk to the owner of th dog first. Most likely this animal is not going to harm either the cat or your kid (I understand your concern for the kid) but a fence would be the easiest and MOST EFFECTIVE solution.

The HOA isn't responsible for your family's safety, but you are.

I think you are on the right track by reporting the incidents of attacks to the Animal Control authority. If you have a restraining order against your neighbor already, other than reporting violations, there isn't a whole lot more to be done.

It is possible that the HOA is following procedure, which doesn't necessarily include informing you of their actions. If, however, they are refusing to enforce the rules, you could speak to a lawyer about suing the HOA. Unfortunately, you may not be able to get them to enforce the rules against your nieghbor, even with a lawsuit, but you may be entitled to damages ($$$).

Good luck!

If it's truly there is a LAW regarding the pets then the police do not need to SEE anything. You can make a citizens arrest, yet again, you'll practically have to force them to do the job they are paid for.
Every threat that is made, call the police and file a report..everything that is said, done, witnessed, call the police and file a report..yeah they'll think you are a pain in the *** but it's not them that is having to suffer...make them do their job.
