You need to have the marriage license from the state or province in which you will be getting married, since the marriage ceremony will be performed according to the laws of that state.
In this case, you would either need to get the license in New York, if you're getting married on the American side of the Falls, or Ontario, if you're getting married on the Canadian side.

The marriage license must be valid in your state. So you can get it from your state and you have 30 days to be married from the date of issuance of the marriage license.
