Whats the situation with using someones trade mark/logo on an item, especially such as clothing. On sites like Ebay you see a lot of sellers offering T shirts . tops etc with a variety of logo's & many state that they can apply any particular logo to any item of clothing ..... how come they can use them..... or can't they?

The people who own the trademarks to the various logos,are watching ebay constantly.They send Ebay their proof of TM ownership,and then they go after the people who are selling the merchandise(unauthorized).Usually shutting down their ebay account,and then suing them for damages.Always ask if the person is officially licensed to sell a product baring a logo.The may say they are in their ebay ad,but ask them.

Some eBay listings are from licensed vendors who do have permission. Many listings are on items where the logo's are already applied (breaking job lots or bulk purchases).

If you want to apply someones trademark contact them and ask about costs and procedures. We hold trademarks to make money; if you're willing to pay we're willing to talk to you. At worst, we'll just say "NO".

They need the license authorization of the brand.

They're copyright. Using them is breaking the law.
