My business partners owe me money and have written a check lesser than what they owe. They agreed to pay me in that amount but they took some other bill and deducted from the actual amount that they owe me without discussing the bill with me. Basically, they took my money without asking me. Do I have the right to sue them? Can I win if I go to a small claims court?

Did you actually owe them the money that they withheld? If so, taking them to small claims court will probably just solidify that you owed them the money. If you clearly didn't owe them anything, definitely take them to small claims!

Sure you can sue. You may even win in small claims court. However, just because you win doesn't mean that you will actually collect your money. You have to ask yourself if the amount in question is actually worth the trouble.

Yes you can. I had something like that happen to me a long time ago when i was 18. i was working at a retail store and there were a couple deposits that ended up being missing. because i was the supervisor, they held me responsible for the money. with no warning, the next time i got my pay check, they deducted the missing deposit amounts from my check!! they didn't even notify me. only thing they said was that since i was the supervisor on duty at the time of closing (of the missing deposits), i have to pay for it. i didn't think that was right at all. my paycheck ended up being like $50. it was a small company so there was really no HR dept. i contacted a family friend who is a lawyer and he advised me that ANYTHING that an employer deducts from your paycheck has to be done legally. meaning, if the employers felt that i was responsible for paying for the missing deposits, they have to conduct and investigation and if they find me responsible, they have to take me to court and make me pay for it rather than taking it from my paycheck. they can't just deduct money from your paycheck.

I am almost positive you can, I think I saw this on Judge Judy, or something. Anyways, DON'T cash the check before you speak with an attorney, or paralegal. If you don't have one, Find one who offers free consultation, so you don't have to pay just to talk to them. My gramma always said, "you don't know if you don't ask"! Good luck to you
