when an exwife opens a case with the child support unit and wants payments to be made to the state, instead of directly to her If the husband is not late with his payments. Do they still go to court or is it dismissed?

He has only been delinquent for a 6 month period when he was in rehab. He has not been before or since and he is paying extra and only has about $200.00 to pay on his arrears. The judge would not hold him in contempt, since he was in rehab.

Well I'm in KY and I'll tell you now that if she's going through the state for child support, the father has not been reliable at all and he can't be trusted to pay her personally. And if he goes to court there has to be a reason like not paying on time or not paying at all. It will not be dismissed. They don't play around anymore when it comes to these poor children not being taken care of by both people who brought them into this world. He's had to done something wrong or he wouldn't be going to court.

If he is paying the state,and is not late, then the state (who is acting on her behalf to collect) should be satisfied and it will not have to go to court. This is true in most states. I am not an attorney so it wouldn't hurt to call them(the c.s.u) to confirm.
