I think it's rude if you're on a date or out with the family. If someone is talking low, I don't mind but most people have what I call cell phone voices. I hate when people think they have to yell because they're on a cell

There are some places where you should turn your cell phone off: restaurants, theaters, movies, hospitals (especially ICU-s). Business lunches can sometimes be excepted from this rule.
But if you're not in the situation to turn the cell phone off (somebody at home is sick, you have small kids left with the babysitter or bigger kids, but you want to be available to them, or anything similar), put the buzzer on, and when you feel it buzzing, excuse yourself and go to talk out of the room.

IF....they have their phone on vibrate
they talk no louder than what they would normally
they do not answer/talk while the waitress is present AND
they aren't being obviously rude to their companion, if
one is present, then, no.

IF they don't exercise the above, in my opinion, yes.

I thought I'd seen it all when I saw someone riding a bike, and talking on a cell phone!!!

It's rude when the server is trying to greet you and get your order. Usually, when a person doesn't acknowledge me when they are on the phone, I just walk away and come back when they put it down....and that makes the whole table have to wait for your rudeness. ya know? so it's not just rude to the server, but to those you are with too.

I hate people that spend all day on cell phones. I am more bothered by those doing it in a movie theatre or those on the phone in the car that are a threat-- to be bothered by those that do it in a restaurant.

its is only rude if the person on the cell phone is noisy, and not polite enough to keep there conversation down or go outside.
