I don't agree with the first, but I do agree with the second. Believe me, I'm a lawyer, and I've tried to read all of those regulations. I even had a professor who worked on the 1985 edition. The Federal Reserve is not a government agency as such, though, and most of the people it employs were once bankers in the private sector.
