I was served a dispossessory warrant. I was one day late responding to the court to ask for a hearing because I misread the date as the 6th instead of the first. My attorney tried and failed with a motion to allow me a hearing. The home I am in was puchased by my sister with assets from my aunts estate while my Aunt was living.(My sister had power of attorney because of my aunt's state of dementia.) My aunt died almost one year ago. I was told by my sister the house I am in was my share of my aunt's estate. Now some Irregularities have come to light over how my sister mishandled the estate and I am being evicted because I spoke up. The house is still in my sisters name. I have been given 2 weeks to get out or have the sheriff remove my possessions. If anyone has a suggestion on how to stop the eviction I would be grateful,as I am very afraid at this point

Ask your attorney if your state allows you to file a motion for a stay of eviction due to pending litigation concerning the estate.

The only way you could have delayed or prolonged the eviction was to GO TOO COURT, Now that you where not able to make that I would say that the Process with the eviction is a MUST so you may want to start Packing up Quickly, I've been evicted before while living in GA, Lithonia and it was due to not showing up for court, And since your Attorney could not delay this YOU MUST GO QUICKLY, You do not want to go through that it is EMBARRASSING and People will STEEL YOUR STUFF, Because it will be put out on the Street, I went through it and to this day WOULD NOT WISH IT ON MY WORST ENEMY. Try talking with the people who are trying to Evict you, If you are not behind on any payments I can not see them EVICTING YOU. I thought you would need to be behind on your payments RENT ect... I do hope this does not take place I WISH YOU WELL. TAKE CARE sweettoni37

You need to stop trying to handle this yourself and get an attorney that specializes in Landlord/Tenant law. It doesn't sound like your attorney does.

There is almost always something that can be done for a retalitory eviction, which is what your eviction sounds like.

What does the will say? Does it say the house is yours?
