I HAVE A QUESTION THEY ARE GARNISHING OUT OF MY HUSBAND'S PAYCHECK CHILDSUPPORT AND WE ARE STRUGGLING TO MAKE THIS PAYMENTS WE DONT HAVE ENOUGHT FOR OURSELVES AND I WOULD LIKE TO KNOW IF THERE IS A WAY TO LOWER DOWN THE PAYMENTS FOR SOMETHING HE CAN AFFORD I HAVE THREE CHILDREN AND THEY ARE NOT HIS BUT STILL IS NOT FAIR SUPPORTING TWO FAMILIES AND NOT TAKING THIS INTO CONSIDERATION

Well I hate to break it to you,But he had the children before you[or at least that's what I'm assuming And that's just how the courts look at it] Sorry!

It may be possible to get it reduced as others have suggested. My question: is the father of your children providing the proper amount of child support for your children. If he is not then you need to work on getting that rectified. It is not fair for you to expect your current husband to support your children but not support the children you knew he had when you met him and married him. If he is a man of character he will make sure that all his child support is current and that he sees his children as often as the parenting agreement allows. If he doesn't why would you want to be with such a man.

Are you working to support your own children?

Yes they can lower the payments but he has to prove a hard ship go to the court and get free legal aid they will give your options if you don't like them you and your husband can pay for an a attorney. but what happen to father of your children can't he help make him pay child support too. he has obligation to his children.

Yes petition the court, FOC has the forms and you can see if they will go any lower. Alot of men don't understand that they can petition the court whenever their financial situations change. Just because the court says one year you have to pay 500 a month, and the next month you lose your job, he can petition the court to get it lowered.

The courts are not in it to make you broke, they are however there to make sure that his kids are taken care of.

There may be a chart used in your state that determines the amount of child support paid. It is non-negotiable. If his income has dropped in the last year he can file for a review. You can file once a year for a review. Be careful! If his income has increased in the last year he could end up paying more.

You and your husband need to go to legal aid in your town.Ask a lawyer to help you get a child support payment that he can afford.Hope this helps you,it did for me. Best of luck to you.

it usually comes out to 20% of his paycheck, and yes, it may not be fair to you, but is it fair to his own child that he supports someone elses kids instead of his own? this is the man you wanted, take him for good or bad, but don't sit there and complain about what is fair unless you look at what is fair for everyone
