Yes, it is illegal, and punishable by anywhere from 6 months in a county jail to life in the state penitentiary, depending on the amount possessed.

It is illegal for recreational use in any state. Some states have taken the option to legalize it for medical use only. This may be what he is referring to, although most states vote no for legal medical use whenever it is proposed.
