There is a taqueria downtown next to Jack 'N' the Box, I believe the name is "La Victoria", the bathroom is always out of order. I asked one of the employees where they go to the bathroom and she told me she just goes to Jack 'N' in the Box. I wonder if the people who own Jack 'N' the Box are aware that a seprated business entity is using their bathroom facilities. Is this legal? I swear every time I go there is sign saying that the bathroom is out of order I began to wonder if they actually had a bathroom.

Either your state, or, more likely, local ordinances would dictate that.

I would BET that the business requires a restroom for it's emloyees, at least. They are required to wash up before preparing food.

I would not be surprised to learn that a working restoom for patrons is probably requried as part of the local health codes.

If your goal is to either have the owner fix the restooms or shut him down, then report it to the local Health Department. If you are merely cuious, or don't care, I would definetly NOT eat at that taqueria any more.

I know here in Texas, as long as the establishment has a lobby, they must have a working public bathroom.

You should report them to the health department, this is not legal or healthy. I for one wouldn't even eat there anymore...gross!
