The chance of that really coming from an M&M is almost impossible. Did your friend have unimpeachable witnesses? Did he save the offending candy? Is he only looking for the cost of the repaired tooth?
If he thinks he has hit the lotto he is sadly mistaken. An attourney probably would not take this on a percentage basis so he would have to pay up front. Tell him to package the rock up along with his dental bill and call a few attourneys and see what they say. Mars candy company has attorneys on staff to fight this kind of thing. Even if he wins one suit he probably will lose the appeal. Remember the lacy who spilled the coffee in her lap? She ended up getting nuttin!

Food companies are not allowed to put stones in their products and in similar cases courts have awarded considerable sums.
Your friend should hang on to the remainder of the food in the jar and have an exploratory talk with a lawyer on a no win no fee basis. The lawyer will then be able to tell him if he has a winnable case or not, what other evidence he needs etc.

Personally, I would say no. You would waste more of your money for the lawyer and court fees and such when chances are you'll loose. Remember Hershey is a huge company, they have the best of the best attorney's. But you can always call legal aid and get some free advice.

No, the only avenue you have to obtain anything in this matter is to contact M&M, tell them your story, they will send you coupons for free M&Ms, etc.
If you were to take them to court, there is no way you could prove that the 'rock' came from the M&M bag, and even if you have the rock, they will run tests on it to prove that it didn't come from your bag... I highly doubt that it would even get that far. Call or write M&Ms.. it's the only way you'll get anything from this!

Was this rock found upon first useage of the said peanut butter? If so, perhaps. Hard to prove though.

Write a letter to the company. Don't put it in terms of "I'm going to sue" but rather as a good samaritan, that you want them to know it was there so they can watch out for other problems.
If you still have it, include the information from the package (or send it in).
They don't want a lawsuit, so might send you something nice--like a lifetime of M&Ms.
