Normally you have to vacate as soon as the bank takes possession. You might be able to negotiate this, but the bank is under no obligation to let you stay.

I know you could probably talk to the lawyer that you are doing the bankruptcy through and they should have a better idea of how long you could stay living there. I know a friend of mine that filed bankruptcy and she stayed in her home for 4 months after she she started the process. I do not know if that would be the same in your case, I think it all has to do with how fast the people that you have the home loan through push the issue. Good luck!

If you return the house to the bank, you would have to leave pretty much immediately (State depending, 30-90 days). The usual point of bankruptcy is to avoid having to give up your home.

At least six months. It will take that long to process the bankruptcy. Then, you will be give 30 days to vacate the house.

My ex didn't get kicked out of my old house for almost a year, I think, but I think it can be as little as 30 days, depending on how the bank proceeds with the property.
