Depends on whether you declare the child a Canadian Citizen or a US Citizen!!! Which ever citizenship you give your baby, the laws of that nation would cover the child. Not being an attorney however I really do not know that for sure.

I don't know the answer to this question, but I know that if I were you, I'd contact an American attorney as well as a Canadian one, just to be sure that everyone's on the same page.
It's terribly sad that you're in this situation with the child's father. The baby's not even born and you're wondering about the custody battle....

Your baby will be a dual citizen in that Canada will claim it based on the location of its birth and the US will allow it citizenship based on the citizenship of its father (I was born into precisely the same situation as your baby and enjoy dual citizenship to this day.)
None of that has anything to do with him taking your baby, though. Legally he'd have to take the same steps any father would have to take to remove a child from the custody of its mother: go to court and petition for sole custody. Naturally, depending on the type of guy he is, he could just pick the baby up, strap it in a baby seat and drive off to the States never to be seen again. But he'd be guilty of kidnapping. You guys are going to have to work out some arrangement for custody (since it doesn't sound like you're married) but I don't think it would be easy for him to get permission to remove the child from Canada.

He can't force you to do squat, no matter what he says.
About the only power he has is through the courts, and that will only be when he wants visitation set up for the child.
I don't believe the Canadian government would let one of its citizens be railroaded by a citizen from anywhere including the U.S.
I think the U.S. would have a hard time swallowing that one too.
You can always get a restraining order on him if he is harassing you.
It would be up to the courts to deal with the parent angle, and to guarantee your safety.

He can't take it away based soley on the fact that you are Canadian or live in Canada. Those things generally rely on judgements of your ability to be a good parent. Joint custody or legal battles across borders might introduce a complication, but I have to assume it's not all that unusual (at least for the US/Canada border).

The baby will automatically be an American Citizen. But American law does not force you to do anything. So the answer is no unless there is a Candien Law that forces you to leave.

Nope. The baby will be a Canadian citizen. He will have to go through the Canadian courts and they will not make you move.

Basically, no, he cant.
Unless he goes to court and proves that you are an unfit mother, like proving that you are a drug abuser or child abuser. Otherwise all he can do is sue you for visitation rights.
