First of all, thank you for your services for almost a year. Although I do love living at Oak Tree Court, the cost to live here is something I can not afford at this moment in time. I will be fully moved out of apartment 242 by Wednesday morning because the moving company, Starving Students, will not be available until then. I was not planning on moving out, but I recently lost my job and I am between jobs right now. I simply can not afford to pay the rent plus my other bills. If you can please be patient and not report me as an eviction until Wednesday August 9, 2006 by noon, I will promise to have apartment 242 vacant. Thank you for your time and your business.

my apartment has not evicted me yet. this is all voluntary because of non-payment of rent of this month. it was a 3 day pay or quit thing. i don't want to pay 1,300 i can't afford anymore. my manager has already asked me to leave, so they dont have to call the eviction people, because if the apt is vacant there is nothing they can do, im gone. but the moving people are not available to come out til tomorrow, which is wednesday. i am not behind my rent at all, just want to move out now, but i will be breaking my lease. my apartment is pretty much concerned with me living here for free til wednesday, but i can't move my stuff by myself.

if you where issued a pay or quit take the quit and run out of the place, under that offer you will only be required to pay rent up to the third date of the pay or quit once you leave they can no longer hold you to any other rent past the quit notice, but you need to move now
basically a pay or quit is giving you the option to either pay and continue the lease or end /quit the lease by a certain date so take it and run they will not be able to charge you for rent after the quit date if you have moved out since at that time the lease is over

Can you explain your situation a little bit more. Are they forcing you to move out or doing it on your own. If you are moving out on your own without them forcing you, you might have to pay them 2 months rent or something along those lines. YOu should take a look at your lease agreement and see what it says and how long its for. You might be on a month to month lease or a year or whatever. I would not send that letter if they do not know anything about you leaving. I would just call the office and explain that you will have to be moving out due unforseen circumsatances. If you are breaking your lease your landlord can sue you for the rent and reasonable costs (ads etc) during the time it takes to get another tenant. You should have discussed this with them earlier because many times when a landlord is faced with a tenant who cannot pay, they will allow you to break a lease without penalty.
No one can evict you overnight. They would have to file in court first, and wait for due process.

Your letter sounds fine to me, but I do have one question....Why do you think that they would report you as an eviction? It seems like you are voluntarily moving, unless you are behind in your rent. If that is the case , you might want to revise your letter to state some kind of arrangements for payment. Otherwise, it sounds fine . Good Luck !!

Don't put the P.S. on there, as it's only going to make the property manager mad. If you want to inform them of the lack of hot water, just put something to the effect of "P.S. You may want to get the hot water checked as it has been unavailable for a month or so."

Um, it seems fine. But in the P.S. it should be spelt 'bear' I think, not 'bare' and you should finish the last word and write 'anymore'.
