It is not a means of control. We have been apart due to finances for 6 months. When the marriage started falling apart a month ago, I came over to work it out and stay. Now she doesn't want to work it out, because she says she's interested in someone else. She is the love of my life and I'm trying my best to work it out. Still, she uses the child as her means of excuse by saying I wasn't there for them. I know I have been wrong on some issues, but my marriage and family mean everything to me. In a months time I have spent a total of 8 hrs with my son by ourselves.

It takes ALOT for a judge to take away custody from a mother...either a history of abandonment, drug abuse or putting the child in danger (repeatedly). So if you are going to gain custody of your child...do you really want that kind of person back in YOUR CHILD'S LIFE, much less yours? I know initially it feels like you can't live without her...blah blah blah. Give it a few weeks, don't think about it...and you will understand it is really the best thing for you (AND YOUR CHILD).

Aside from this...the chances are not good...she is DIVORCING YOU which usually means. Done. Over. Finished.

Good luck!

All depends on why you are apart, I would say. Just because you get granted custody doesn't mean it's going to take away whatever broke you up in the first place.......

She'd still be able to get visitation, and you never know she may actually like the freedom that she has. Some moms are ready for the break.

Don't try and use your child as a tool, if it has gotten this close to a divorce, I hate to say it......but, I doubt you both will be together any too soon.
Good Luck.

custody battles are ugly never endearing. your relationship is done like dinner move on. get a visitation agreement in place and pay your child support.

if she wants a divorce, she wont be coming back, and the Judge usually doesn't give men custody
