i am a british citizen and moved to the usa ..and i am trying to get joint custody of my british son so that i am able to have him on holidays and so on ..because my ex is uncomfortable with letting me have hime due to no paperwork and thinking i won't return him to her (which i wouldn't do to him or her ) i just want him for holidays (vacations)

I think the "HATE" in the first answer is a little too strong.

Conversely, I see the good intent in you asking this question.

I'll start with a joke - "You won't get anywhere in US courts using the word "whilst" " I'm kidding of course.

But the first answer does raise some practical realities. Your spouse would be imprudent to let any common child go with you to another country. It creates too many legal, jurisdiction, and custodial issues. If you are going to live in the US, you must face the practical reality of visiting the UK for all your visitation, unless you get a court order allowing you custody of the children in the US. Getting that will create a fight most likely.

You will need to talk to a UK lawyer to determine your chances.

No parent in their right mind would let a child in their custody travel to ANOTHER COUNTRY to be with the other parent.

Move back to Britain. I cannot fathom a mother who would leave her child like that.
