I just noticed in a store that one has to have a valid driver's license as proof of age to buy cigarettes or alcohol. Why wouldn't a license that is expired be acceppted as proof of age.

Because once the document has expired, it is no longer considered valid identification. Realistically, and as common sense would dictate, the document would still optimally function as sufficient proof of age, but very often the law operates outside of common sense.

Store policy. Technically, the license is not acceptable as a form of ID if it is expired. They only card for cigarettes and alcohol, they're not going to accept an expired ID. Why don't you have a current ID?

Once a drivers license is expired it is no longer a valid piece of ID, in fact banks wont even take it to verify that you are who you say you are. If they can not take it to compare the pic and see that you are who you say you are, what makes you think they would believe your birthday is correct?

as a bouncer in a bar i will tell you it is easy to get your hans on an expired dl . cut the pic out with a razor blade or exacto knife. i have personally confiscated dozens of these. if you have an expired dl then you should have a new one. for some reason you lost your dl due to a driving offence you can get a state id or a passport. nj law prohibits a expired or even a duplicate licence without a form of back up such as a passport or military id.

The store assumes that a person with an expired license will give it to an underaged shopper. After all, they don't need it anymore, they have the new one.

The fact that it is expired means that the license is not valid. I sure hope you were not driving with that license.

They could accept an expired license, but choose not to, because they are subject to enormous fines if they get caught selling to minors. They don't want to risk their licenses to sell.
