At age 12, a child can have a say, but not the whole say, about which parent they live with.

Usually at the age of 12 a judge will take the childs wishes into consideration when deciding custody. However just because the child wishes to remain with one parent doesn't mean that is what will be done as it will also depend on if you are able to provide for the child. If both parents are fit parents and can provide for the child then usually where the child wants to be after this age is the deciding factor. I would try to talk to the ex and see if the two of you couldn't work it out without court though as the child will then feel like they are choosing sides.

That depends. Some twelve year olds are very articulate and can explain why without being coached, where some 16 year olds cant tie their laces without help. Different states have different standards. The judge will want to know where it is best for the child to stay not necessarily where they want to be. Imagine a case where dad lets the kid get away with murder while mom is pretty strict? where do you think the kid wants to be? where is better for the kid to be? Most importantly dont you try to influence the child's words or wants, the court will see right thru it and may well hold it against you.

I think it depends on the state laws. Courts are probably more likely to listen to a child 12 or older though. At least I'm hoping so, as I have a 12 year old stepson that wants to live w/me and my husband and we're hoping to get custody. I live in Ohio, and from what we were told, there is no set age anymore.

A child is considered a child all the way up to being a minor. Age for minor is 17- 18.
A child has no say so in where they want to live.
Parents decide until they are at least 20 years old.

it really depends on the circumstances. I would say 14/15 - unless of course one parent is completely incompetent and unfit... A child, especially a teenager, will want to live with whichever parent is more lenient... Of course, the grass IS always greener. I would sit down with your ex and your son and discuss it rationally together. Good luck.

Age 18, but you will need to go to court and he would have to speak to the judge and tell him why. The final decision will be made by the judge

My friend just got custody of his son (age13) . The judge talked to him and made the decision.
