Employers can refuse to hire anyone they choose. This accident you speak of, were you off of work due to the accident and did you get fired for the accident? If you were off of work because of the accident, they have to let you return to work or lay you off with unemployment benefits. They cannot fire you because of the time you missed work due to the accident.
