i am a surrogate but moving to spain and my intended parents want to make sure surrogacy is legal in spain

I am from Spain and I'm afraid it's illegal. There won't be any problems if you're in Spain while you are pregnant but if you give birth in Spain, you'll have a problem as legally the baby will be yours. If this happens the only way you can give the baby back to the biological parents it's if the father asks for it and you agree or a judge does.(point 3 of the article)

I enclose the article of the law which covers this subject(the original one, in Spanish):

Ley 14/2006, de 26 de mayo, sobre técnicas de reproducción humana asistida.

Artículo 10. Gestación por sustitución.

1. Será nulo de pleno derecho el contrato por el que se convenga la gestación, con o sin precio, a cargo de una mujer que renuncia a la filiación materna a favor del contratante o de un tercero.

2. La filiación de los hijos nacidos por gestación de sustitución será determinada por el parto.

3. Queda a salvo la posible acción de reclamación de la paternidad respecto del padre biológico, conforme a las reglas generales.

Summarising in English, the law says:

1. Surrogacy is illegal. Any contract will not be valid.
2. Baby's parents will be assigned when you give birth.
3. Biological father has the right to ask for baby's tutelage following standard procedures.
