Came home & the girl's mother had put a note thru the door saying that her daughter had crashed into my stationary car with her bike. My ins comp are calling me with details of how I can claim, I have claims protection, but can I get the 6yr old girls parents to cough up some money (or at least the excess). Does anyone know my rights here?

Depending on if they are friends or not it's a tough situation, yes by all rights she needs to fix your car. I know that I watch every penney i spend and I keep my car nice so I guess I have to say to go through with fileing a claim. I would.

You've got a legitimate claim against the parents although I think it would be their homeowners policy that would pay you in this case - Unless by bike you mean motorcycle OR they chose to pay out of pocket. The other thing is you've got to find out who their homeowners insurer is in order to put in a claim.

I recommend getting an estimate for the damage and presenting it to the girl's parents and see what they say. If you use your auto insurance to cover the damages they probably can't surcharge your policy BUT if you have other accidents or violations on your record they might be able to cancel you at the next expiration date.

You may be being overprotective. Are the children playing around or wrestling around, and her daughter is getting the better of your daughter? Or is her daughter truly attacking your child for no reason and your child is not wanting to play that way? If it's the first, then you need to step back, if it's the second than you need to step in and disallow the behavior. However, shouting at your sister about it is not a good way to handle it. You should have discussed it with the mother in a calm manner. And if you see her daughter hit your daughter, and she says/does nothing, than walk up to her daughter and say hitting someone is not allowed, you need to use your words and talk things out if something is bothering you.

I was injured by a kid like that. I hired attorney Ray Pacello and he got the parents insurance to cough up the dough. http://www.san-diego-personal-injury-lawyer.org/pages/633682/index.htm
