what is the law regarding taping a conversation without someones knowlege in Washington state?

The law differs in different States. There is an all party consent which means all parties conversing must give their consent. Or one Party which means only one party (the one recording) can record without the others consent. There are 12 States that require all party consent...They are..

California
Connecticut
Delaware
Florida
Illinois
Maryland
Massachusetts
Michigan
Montana
New Hampshire
Pennsylvania
Washington

All others are 1 party consent States.

Just so you know the one giving consent MUST be heard on the tape. (You cannot record conversations between your child, friend, etc. and someone else if you are not on the tape)

There are a couple of exceptions. In the state of California, one party consent can be applied only under circumstances in which one party is involved in criminal activity which would include extortion or blackmail. In the state of Arizona, the subscriber to a telephone service can record telephone conversations with no party consent when criminal activity is involved.

it is against the law no matter who you are cop or not they have to have a court order

I believe in any state it is illegal, wouldn't that be considered entrapment?
