We already have a well exprienced attorney. I am just looking for any additional information or advice from those who have gone through this before. This may be the first of many against this developer as there are other buildings with similar issues (in the same neighborhood). We have tried to settle on an amount for repairs but as you may have guessed the developer is playing hardball.

Just want to add we do have a detalied engineer/inspector's report (from an inspector that is well respected in the city) with some photos even identified the issues in the draft of the demand/complaint which the developer saw. Our major issues are leaks through walls and the roof. Again the report was well detailed my guess is that he (the developer) is trying to bluff us into expensive litigation hoping we will back down.

We went through this process although it never got to court. We hired an professional engineering firm with condominium inspection experience and presented the builder with a fifty or so page report and about 700 photographs. He was overwhelmed and we reached an amicable settlement. The report ended any argument about what fact were true. The developer, who was quite experienced in condominium development, did commend our effort. It cost a few bucks and a lot of our time, but the final settlement was well worth it.
