It depends what country you are in? in the Uk a child is defined as anyone under the age of 18 years. A child has the right to be included in all desicions affecting their care.

Well, the laws are siding with doctors over the parents in the treatment of their children, especially if the parents are choosing not to have their child treated and it is something that is life threatening. There is a case here in Wash state now where a woman kidnapped her 9 month old son from Children's Hospital because she did not want him to have surgery on his kidneys, but he would have died eventually.

The guardian or parent is normally the one who makes legal decisions for children unless the parents/guardians are endangering that child.
