Maxine you need to seek legal advise. They are breaking the Law. This is a very low way of bullying people and your ex-employer should be brought to Justice.

You can inform the places that you are applying to that there could potentially be a problem with a reference, and to state the reason. Academics prefer to hear in advance about a potential problem with a reference before they take them up. That allows them to judge the reference more appropriately and give you some lee-way if there is a problem with one. You could ask the university to consider the applications on the merits of the references already provided, tell them what the problem is, or ask if you can request a reference from a different person.

Ideally though you should change to a more appropriate reference in future.

in what way could an ex employer possibly influence a university accepting you onto a course that you will be paying for? If you have the relevant qualifications to undertake this level of study then i cannot see what the problem is.

Don't quote him/her as a referee-there is nothing stopping you choosing someone else and you don't have to give a reason why you haven't chosen them.
