Sirhan Sirhan is not "accused" of killing RFK (as your question implies), he was "convicted" of the crime. For political reasons he will never be allowed to leave.

If this sounds unfair, consider that the judicial system cannot (repeat: CANNOT) seem to be either weak or forgiving about political assasinations, because nobody can be allowed to substitute his own judgment (which is what all political assasins do) for the judgment of the people. The people must rule, not the assasins. And Sirhan Sirhan (who in effect said that because he didn't like RFK's opinions nobody should be allowed to vote for him) will die in prison. To release him sends the worst possible message, and threatens the foundations on which democracy rests.

Sirhan stated he loved Kennedy but turned against him for supporting Israel (Sirhan is Christian but anti-Zionist - as are some Jews) - though Kennedy was maybe just trying to get Jewish votes.

I doubt they ever will. Sentences for political assassinations are very strict and long.
