she has been there since she has been 2. her dad has only been present off and on. never living with her. now that she is 14, he wants her to come live with him. he is the one who does have custody, he never gave custody to his mom although that is who she has been with since she was 2. i have visitation. my daughter does not want to go to her dads to live. she wants to stay with grandma. what can i do to prevent him from taking her? what are her rights, what is my rights, what is grandma's right? what do i do? i am need of answers fast!!

Have the Grandmother petition the courts for custody. Ask the courts to appoint your daughter a law guardian. The law guardian should act in defense for your daughter.

Go to the Judge -- especially if the Grandma has been sole caretaker over the years since -- and I am assuming there is a valid reason the dad is not involved with her up to this point?

She SHOULD, under most states, now be at the age where she can express her own desires to the court on where she wants to live and with whom -- be it yourself, the grandma or anyone else.

Grandma also needs to obtain a lawyer -- because it sounds like he is a deadbeat -- and she needs to protect herself from him. She needs to make sure that she has LEGAL Custody, because, heavens forbid, she has to make decisions that dad won't be willing to make (like, how does your daughter get medical treatment -- it is the custodial parent that usually does that).

This is very complicated. Get help -- and (unfortunately) it is going to cost money that you most likely will not have.

Your grandmother hopefully has documented somehow that she has been living with her for so long....she has the right to go to court and ask for custudy of this child....I also beleive that the child has a right to say where she wants to live....being that she is 14 now....i beleive that a judge would also rule in the grandmothers favor for the child to stay in the home.....she needs to file for custody of this child IMEDIATELY!!! Have her get a lawyer and he can help her through the procedings and advise her more as to what she needs to do (the grandmother)...Good luck with that.....

u should seek legal help a judge mite let her decide considering her age
