Now, in general, all employers will be subject to the higher federal minimum wage laws. If, however, the business does not engage in interstate commerce (get any products, goods or services from any other state, have customers or do business in any other state, etc.), then and in that event, the state minimum wage applies.
This is because Congress con only regulate business engaged in interstate commerce. The "commerce clause" of the constitution, however,has been BROADLY interpreted by courts, so virtually every business is subject to that clause.

The federal minimum wage is an overall minimum - states can have a higher minimum wage, and many do, but employers have to pay at least the federal or state minimum, whichever is HIGHER.
At the federal level, minimum wage is currently 5.15 an hour for employees who don't receive tips. It's 2.13 an hour for people in jobs where they receive at least $30 a month in tips. See reference below, which is from the federal Department of Labor. This site gives federal and by-state info. The state info shows that what Kansas still has on the books is 2.65 per hour for minimum wage, probably because they haven't bothered to update it in many years since it means nothing anyway - the federal minimum overrides that, to $5.15 an hour unless people are working in tipped jobs.

OK, I live in Kansas. It is true . However I don't know of a single place that starts people out at less then 5.15 per hour other then waiters who get tips. Thank heavens I make more then that!

i dont know where you got your facts but they are wrong. and in all states, yes the federal minimum wage overides the state wage, the state can have a higher minimum wage but not lower.
