my daughter who is ten called me a while ago her mom says she wants her to move in with me but she still wants custody of her and for her to go to the same school that she has been going to i want her to stay with me but what legal options do you think i have?

Your wife still wants custody of her because then she can still get child support..........If your child wants to be with you and the ex is willing to that is great but get it in writing, all you have to do is go to a notary and have her write it out that the child will be residing with you she will still obtain custody but you will be the guardian and no child support shall exchange as long as the child is living with you. There are not many men out there who would be willing to take on a 10 year old girl so for that you are commended but you have got to protect yourself legally as well. If the ex is not willing to notarize something saying she will forfeit child support then I would say either wait and go to an attorney and fight it out or go ahead and take the child and keep paying the mother the money.

Obtain custody now! If your wife retains custody, you'll be ordered to pay child support. Don't make any "back door" arrangements with your wife. Get an attorney, and go to court, request custody as your wife wants your child to live with you. Best of luck to you and your daughter!

Joint custody with primary physical to you. Sounds like she doesn't want to change things for financial reasons (taxes, support, etc..). I would make it a legal change, by submitting a Stipulation and Order to the Court. Support is generally based on the percentage of timeshare. If you are paying support, I would recalculate.

Ask a lawyer and find out. She should be able to have a equally fullfilling relationship with both parents. The school might make it easier for her to stay with friends and communicate with her mother. I'd be going for joint custody, though, if I were in your shoes.

WHY GET ALL INVOLVED IN THE LEGAL ASPECT OF IT ALL. YOU TWO ARE GROWN YOU HAD YOUR DAUGHTER TOGETHER WITH OUT THE HELP OF THE LAW SO JUST LET HER COME AND STAY WITH YOU .WRITE SOMETHING UP SAYING THAT THE LITTLE GIRL WILL BE STAYING WITH YOU AND THE MOTHER KNOWS ABOUT IT . MAKE SURE YOU GET HER BIRTH CERTIFICATE AND SOCIAL SECURITY CARD AND GET THE LETTER NOTARIZED. AND CALL IT A DAY. OH BUT IF SHE IS DRITY LIKE THAT AND WANTS TO TRY TO GET CHID SUPPORT THEN F UCK IT DON'T LET HER COME AND STAY JUST PAY THE CHILD SUPPORT AND KEEP IT MOVEIN

If Mom thinks you are suitable for caring for your child then she should be willing to give joint custody. To do otherwise is just an attempt to exercise power and control over you using your child. Insist on joint custody.

Your ex can't have it both ways. Get her to sign custody over to you on a trial basis. You can also ask at the university in you area that pertains with legal advice. its free. good luck

legal options are . if your daughter moves in with you . you have the option in where your daughter goes to school.and if you are paying for most of her school supplies or all of it and are clothing her and doing all the other necessary things your daughter needs then you are the one who makes the major decisions concerning your daughter.

if she lives with you , you will need the child support, that is only fair..If she lives with you and you go for support you will get it...
