I dont understand your plight here. You own a company and someone has posted a site that refers to your business? Firstly, if they are generating business to you, why would you be upset? If they have simply designed a website with your business name you need to find out when they put there site up. Maybe YOU are infringing on THEM! If they purchased the domain name the best you can do is buy it from them.

Unless your company name is copywritten, then the domain of the same name is up for grabs. I'm sure there are hundreds of Joe's Hardwares all over America, but the first one to put up the web site will control the domain name.

If it was put up by someone who doesn't actually have a business of the same name, you could try to contact them and buy the domain name. If they're sladering you or your business you might could try to sue for slander or liable, but likely they're covered under the 1st amendment.

Probably best to just forget about it or try to buy the name so no one else can use it.

Not really. There is the matter of copyright and trademark but that's a long legal way, not to mention a costly one.

Usually you can 'buy' the site from the hijackers and that's a lot cheaper usually.
