SIMPLY a murder ? There are different types of murder ..
Crimes of passion are looked at differently because they are not pre-meditated .. For instance , a guy comes home and finds his wife in bed with and doing another man ... (this could be a woman finding her hubby too ) The guy is enraged and goes nuts (temporary insanity ) kills the guy and beats up his wife .well , chances are he would be charged with murder by the District Attorney but his attorney would argue for a lesser charge because of the circumstance .....
crimes of passion are just that . The passions are aroused compelling the person to go on survival mode and he or her goes into a frenzy that he is not responsible ..It is the sudden situation that drives him to commit a crime that he would not have otherwise committed ....

I don't think in a crime of passion that it is simply a murder , in a crime of passion there are dynamics involved in which the victim has a role or a perceived role in bringing about there own demise. In other words a normally sane person who wouldn't otherwise have considered murdering someone is driven to act out of character due to the actions of the victim. For example a husband who comes home from work early and finds his wife in bed with another man , he is brutally confronted with the realization that his wife has cheated on him and is driven to kill the man . In a different situation such as the wife calmly telling him she is leaving him for another man , the chance exists that he may handle it in a more civilized manner. Though I don't condone any of the above I agree that it is looked upon differently and as it is , the degree it is looked upon should be quite limited in my opinion . Such as life imprisonment over the death sentence.

It has to do with culpable mental state or capacity. Crimes of passion for some people are looked at by the courts as instances of rage wherein they are blinded to the consequences of their actions due to the sequence of events that triggered the rage being beyond their control and too much for them to handle. Usually...crimes of passion are for the people who are emotionally unstable or mentally unstable. That sounds pretty smart...but it's really not, I don't think...but it works. I kind of threw that all in there off the top of my head. It's all in a CPL though. You can probably look it up online too. And I disagree. I don't think that there should be crimes of passion because that's telling someone that it's okay for them to do whatever they want as long as they are incapacitated by their own feelings. It opens up a whole can of worms that creates more crime. Or as it is stated in Batman Begins, 'Criminals thrive on the indulgence of society's understanding."

Crimes of passion are not premeditated and planned out. It takes a lot colder of a person to sit down, plan a murder, and then carry it out. When I was a younger man if I had caught my wife in bed with another man (for the sake of argument) I might have lost it and killed them both. Of course, I am older and wiser now and none of that happened. Consider it though...I am a useful member of society...I work hard, pay my taxes, and take care of my loved ones...all it could have taken was a moment of madness for me to be doing time right now.

It all comes down to intent - Murder means premeditation, crimes of passion means spur of the moment killing. End result is the same, to be honest, don't know if many courts would let you off lightly on a "crime of passion".

Usually a crime of passion is looked at as temporary insanity. It is much different than a premeditated murder where it is planned in advance to kill someone.

Because according to the law,murder is still a crime no matter what the circumstances that lead to it.
There is not one excuse,(save self defense) that justifies taking another human being's life.Just because O.J. Simpson
was in a blood red rage and blinded by passion and jealousy didn't give him
the right to ruthlessly murder those people to illustrate my point further.
Accountability is accountability.Law is law.

Crimes of passion can amount to a number of things. Does a person convince a person to commit a crime out of love or jealousy? Does a person commit a crime because of a warped sense of reality. Does a thief steal or commit crime to help the one that they love. Alot of times hollywood portrays people who commit crimes of passion as a hero, and ones upholding the law and doing the right thing as the bad guys. Regardless of what it is crime is still crime, and should be viewed as such. I know you can try and plead mental instability out of love or loss but there are always consequences for actions regardless.

murder usually requires intent and planning, while a crime of passion is spur of the moment. You shouldn't get off for either, but I think a murderer is more like to do it again.

Because crimes of passion are involving a close relative...that's why you would get less time in prison......In others words it was in the heat of the moment!!! (But notice, it is still murder)
