I'm in wv. The landlord is here twice a year and i pay a go between the rent money every month. I have nothing in writing. I have been given about thirty days to move however notice came while on vacation. which reduced time by about a week. I want to know if there is anyway i can get the time extended in order to have time to look for a place. I have been here for 7 years and have done nothing different now than i ever have. I think he just wants me out because he knows i was looking for a place to buy and he has other people wanting to rent the house. The wiring and plumbing in the house are in a terrible state. There are 8 rooms all hooked up on one breaker. And all the fixtures in the bathroom are starting to leak. Can i make it so he has to fix all this properly before he can rent it out again?

also may i add that my rent has not been more than a few days late in the last 2 years and in the entire time i've lived here i've only been 30 days late twice which i paid two months rent to catch it up those two times when it got behind. He is just wanting me out cause he knows i've been looking for a place to buy and someone else is wanting to rent the house. I have done nothing different now than i ever have the whole time i've been here.

As far as the notice goes, you need to be served at least 1 full rental period before the notice takes effect. I'm not sure about where you live, but here if you were not served properly and with sufficent notice, you can have the matter dismissed and the landlord has to start all over again.

Also, the landlord has to file in court to have you evicted, and he can't file for possession until AFTER the notice period is up. You don't have to move until he has a court order saying you have to.

You will have to check the law in your area, but many places prohibit "just because I feel like it" evictions.

It would be worth your while to contact a local attorney who specializes in Landlord/Tenant law and to pay for a consultation to find out all of your rights.

The time to complain about the condition of the place was before all this happened. You can still do it, but if you had complained before you could claim that this is a retaliatory eviction, which is against the law.

Being vindictive is not going to gain you any points with your landlord. If anything, it will only make matters worse. You've lived with these problems, as you said, for the past seven years. Don't be a b*tch all of a sudden. Tell him you need more time. If he wants to play nasty, you can make him go through the legal eviction process, in which only a judge can actually make you leave, but you will be responsible for the rent for the duration of the time you remain, and quite possibly be sued for his legal fees as well. Best advise, move.

1. It looks like you've got a 30-day notice, not an eviction notice. You may get evicted if you don't comply, eviction on your record will make it almost impossible to rent another place.

2. Wake up! Its not your house, the owner OWNS it.

You can offer to pay for additonal time.

However, you probably have a month to month lease and 30 day notice is all that is required to terminate the agreement.

If you play games with the landlord, he can damage your credit and you can forget about purchasing a home in the near future.

you can try to ask for extra days or yoyur just out of luck
