Ordinances vary from city to city, but generally speaking, the owner of the property where the tree is growing is responsible for the tree. If the tree's branches extend over a neighboring yard, the neighbor has the legal right to trim the branches back to the property line.
If you plan to live in your house for any length of time, it's worth talking with your neighbor and seeing if you can't come to some sort of peaceable arrangement, because tree problems have been known to start big feuds among neighbors, and that's no way to live if you can avoid it.

You better check with city ordnance before you plant or cut down tree's even if they are in your yard. Some cities have very weird laws, like here it's illegal to plant a willow tree, and where my friend lives it's illegal to cut down a tree unless it's diseased. So otherwise it's the responsibility of the land owner.

If they're your own trees, you are responsible for cutting them. However, if part of a tree hangs over a neighbor's fence and is in his way, he can cut it off (at least that's the way the bylaws are in my city). If this is the case, check your local bylaws. They vary from place to place.
