The ladey claiming to be family delayed telling me about my dads death by 4 days and then had already began getting rid of his stuff befor i even new of his passing.He had an update will but she said that he only had an older will. She also said that when he was creamated that his wallet and contents would be destroyed due to bodiley fluides on it, and that he had no insurence or bank account.This was a lie ,i found the wallet and contents she had misplaced.My dad was a retiered police officer w/medicle and insurance[AARP,disability,S.S.] She has also sighned paper work as his blood sister.He told me and my sister he had a new will done a year befor his death,and told my sister were to find it in the event of his death.It was nowhere to be found.I dont have the money to pay a lawyer to do all these things and no one i have asked can give me direction to resolve this matter.Its been a year and a halfe now, and i feel i let my dad down! How can i find these documents and get leagle help?

what a terrible situation. I can't believe that someone would be that disrespectful of the deceased and their family. It makes me sick. I don't know alot about the law but would strongly suggest finding a good family law attorney. If you have documentation of the last year and a half, you should be able to find someone to take the case. Most states have an ombudsman in the attorney general's office that can direct you to the right starting place. Hopefully, they can also give you advise on how to finance it. As for finding the right lawyer... that one is tricky. Start by looking at who is part of national organizations (you can search these on-line) Some don't take payment until the case is finished and others say they won't unless they win. You really need a family law attorney for this one. You can include attorney fees in the settlement. I am sorry for your loss and feel bad you have to deal with the red tape of probate... no fun. If your father was not married, than any of his possessions, personal assets, property, etc. would be distributed according to probate laws for the state. You can go down to the local county court house, or go on line for legal advice and to get the appropriate forms. There are lawyers that work on a contingency pay scale an others that offer low cost or free services.

The question about her being his blood sister should be easily solved by her birth certificate and his. She might forge a birth certificate, but then if you check with the vital statistics department of the birth town or city you will not get confirmation that her parents are the same parents as your dad's. Once this lie is established, the rest could fall like dominoes.

Check with the attorney who did his first will, most liekly he used them for the new will. That is why a person needs to give copies of will to varoius people.
Hire an attorney, file a motion in probate court to freeze all of your dads property till a hearing.

omg, you can have a DNA test to prove if she is even related to your family at all. file charges with the police. look for a lawyer that might be willing to help you and can get paid when the will is found. Good luck, don't listen to that b*tch!

It sounds to me as if there was fraud and that is a criminal offense, You might consider contacting the police. If your dad was a police officer, perhaps you can contact his associates who can steer you in the right direction. Sorry I can't be more help.

Wow i feel for you... try going to the police.. and see if legal aid can help you as well. Surely something can be done.. at any rate, the police will know where to direct you if by chance they cant help you.
