late on my august rent....my landlord says he will lock my doors if i don't pay a certain amount per week...i have never been late before but just lost my job....can he do this? i live in de...

i will have the money to pay the late fee and the rental amount in 3 weeks as my new job pays me once a month....
he never let me sign a lease, i live in mother-in-law suite......basically i pay him rent and it is understood that i am month to month....
i thought he has to file with the courts to have me evicted, then send me a copy of the paperwork.....i am just scared he will lock me out......and i won't have anywhere to go...

NO, there is laws that protect the resident. Just as there are laws that protect the owner. Look into your lease and read the fine print That isn't an act of humanity.

No matter where you live, he cannot legally lock you out. If he does, go to the police.

Every jurisdiction has procedures to evict someone...locking them out is not one of them. There is a process that must be followed.

talk to an attorney to find out your exact rights, which are based on local laws.

I have read your additional info. He still cannot lock you out. By the way...I don't think he can charge you a late fee either. You are a month-to-month tenent. He's got alot of nerve to charge a late fee....you don't even have a lease.

Best thing to do...pay the rent when you get it. Pay the late fee (if its not too much) and start looking for a new apartment. This guy sounds like a jerk.

First of all, your landlord cannot illegaly remove you from your apartment as such. As a tenant, whether or not you signed a Lease, you are entitled to your rights and are entitled to received notice from your landlord at least 1 month in advance. Odds are, if he is truly seekng to evict you, either he or his lawyer will serve you with a "Thirty Days Notice" which gives you 30 days to leave the premises. If a lease was signed, a 5 and/or 3 day notice might be issued as well. By the time you are served with these documents- YOU WILL NEED AN ATTORNEY.
