I received a DVD from a marketing company today. It says that if I like it, I must pay $10... If not, I must return it in the prepaid return envelope provided. I thought there was a law that says you don't have to pay for anything you receive in the mail that you didn't ask for. Is this true?

Yes! It is a NASCAR DVD. What B.S.!!! I may watch it tomorrow... either way, I ain't paying for it, and certainly not making a special effort to return to sender. They didn't even take the time to spell my name out right.

If you didn't order it, you have no obligation to do anything with it. Keep it or throw it away. You don't have to tell them that you never received it.
You do not have a contract with them. A contract is an agreement between 2 parties. You did not make any agreement with them. Their loss, your gain.

like others have said, if you did not sign for it then the marketing company has no proof yourecieved the DVD. However if you do keep it then you may get a further bill in the post asking for you to pay for it.
personally i'd just send it back with your name and address and demand to be removed from the mailing list.
as for the legality of the situation. i guess if you there is a court case for the payment you could be charged with fraud if you claim not to have recieved the item when in fact you had recieved it.
ethically i class what you have recieved as junk mail, and so you should have just thrown it in the bin. i normally just throw mail out if it is not from my bank or anyone i know.
just do what they want return it to them and may be as i said demand to be removed from the mailing list as well as enclosing a few other items of junk mail with the DVD, and say something like you sent me your junk mail here is some of mine. or to that effect, remeber the heavier the package the more the company has to pay the postal service. so attempt to bank rupt the company as no reputable company markets DVDs or anything else that way. it is only the shadiest of companies who market there goods and services by direct marketing.
i as a rule never deal with any company who visit my home uninvited be that by direct marketing mail shots or in person on the door step.

Even if it is true that you don't have to pay for anything you receive if you didn't ask for it, the marketing company has written out a contract that may be binding to you.
Basically, the contract states that, if you choose to keep this item that they have sent to you, you need to pay them $10. If you choose not to keep it, just send it back.
Either way, you don't have to pay for receiving it. But you have to pay for keeping it.

It wouldn't happen to be a NASCAR video would it? My husband got one in the mail the other day. I'm not sure why he got it. He says he didn't ask for it and he's not paying for it!

I don't if it's legal or not, but I would return it and ask that they take me off their mailing list. That's too much hassle for something I didn't even ask for.

If you didn't order it or it wasn't in the small print attached to something else you did, then yes, you can keep it if you didn't order it. How are they even going to know you got it? I hate scams like that!

They certainly can't MAKE you pay if you didnt ask for it. Just send it back and say you didnt like it.
