my husband and I got married in 1989. A year after we got married and a child I found out that he submitted a fake divorce papers when we got married because the "wife/ex-wife" needed to be still married to him for immigration purpose.
So what happens with my marriage now? is it valid? and what happens to our child is she legitimate of illegitimate?

I think that you are not legally married to this man because of the first marriage. Your husband could face some serious charges. It can all be straightened out if he really wants to correct the situation. I hate the term you use for your child - legitimate or illegitimate. Your child is still your child no matter what. Your child is legitimately a child.

Your marriage is not valid and your child would then be illegitimate. What your husband did was commited perjury and bigamy, both of which are Federal Offenses. I hope you get this fixed before someone catches him and he is arrested. And, to your amendment, if the child in question was born on US soil, he is a citizen, even though the mother is not.

As an attorney, I can inform you that you are not legaly married. Your supposed husband is going to find out that he is in quite a pile of "DOo Do" once the IRS catches wind of this. Then there is the question of how much support he is going to owe you since he fathered a child with you.....the list goes on and on and on.

What marriage? He faked the papers. Forging a document like that is quite a crime. He is also guilty of bigamy. He's probably looking at doing time over this. You need to talk to a lawyer and see what your options are.

your marriage is null and void. However your child is an American citizen, but tecnically, he/she is illegitimate since your marriage is not valid. your husband has a big problem.

This is the problem with divorce decrees all you can do if someone doe's not do what the court has ordered them to do is drag them back to court and sue for contempt. Good luck.

my mom and dad had go get remarried like 2 times, first time they filed in the wrong zip code, second time they spelled her name wrong
If an I isn't dotted and a T not crossed it's void as far as I know.
