I'm talking about people who go out of there way to make new laws that effect everybody based on the very very few problems our country has..

Ex. One person dies from lung cancer who has never smoked in her life. These people are soo afraid that they will work non-stop to get laws passed all over the country to ban smoking in any public place including bars and nightclubs. There are many other examples as well..

How much of our freedoms being lost is too much??

mermaid- Smoking was just one example. There are others. It's the point that counts. And why should you be able to choose how I run MY business. If you don't like it, go to a different bar! It's one thing to ban it at truly public places like the library or what not. It's totally different to force the owner of a business to abide..

i don't think that's it. here is my theory... these are sin crimes. what i mean is, there are some behaviors that we as a society disapprove of. these behaviors change over time as we mature as a culture, but they typically come from an idea that people have done something to deserve their fate.

have you ever noticed that cigarettes are taxed ridiculously? it is because we all know smoking is wrong (or dangerous), so we don't tend to defend the practice at large or notice when it becomes harder to enjoy a cigarette. the cigarette bans are the same way... no one stands up for the rights of these small groups that follow behaviors we (society) disapprove of. the thing i worry about, is that these laws don't stay in their boxes.

let me just say, i'm not a smoker. i'm also not a person who drives drunk, i find that practice abhorrent. but, has anyone noticed how many funky, funky twists the law has taken to make it easier to convict someone of having driven drunk? we should be very careful with what we do to our civil liberties... it might be hard to take these changes back.

Apparently YOU haven't suffered from lung cancer, but do you think a smoker has any right to cause such a horrible thing to happen to another human being? I have interfaced with a lot of smokers in most of a lifetime, and I can assure you that they typically don't care about whether they harm others or even themselves, and they sure don't care about who has to take care of them or pay for their care when smoking catches up with them. Do you see where smokers are any different in this regard from alcoholics or drug addicts?

The Constitution is clear on this very matter. Every man is afforded every right so long as the taking of those rights do NOT infringe on the rights of others.

If in fact the man in your example died of lung cancer caused by second hand smoke then my right to smoke would infringe on his right to live...which is a pretty serious infringement.

Even if the man's cancer wasn't caused by secondhand smoke then I suppose people would argue that my right to smoke would infringe on his right to have a carcinogen free atmosphere thus reducing his exposure to cancer causing agents...but that's kind of a long shot on that one...

You are 100% correct. The little analogy that I like to use is: You have 20 people wearing baseball caps, 19 of them with the brims in front (the right way), 1 of them has it on backwards. Instead of the 1 person who has it on backwards putting it on with the brim in front, he bitches, moans, screams and sues to get the other 19 to put theirs on backwards like him. Seems kind of stupid right? It may not be the best example but its one I like to use. Anyway, I get what you're saying.
