I had my first child last year in oct. my baby was born at 7 months and was stillborn. then specialist who came in said my baby had been dead for at least 2 days. If that was true then my docotr should have know because i had a appt two days before i have given birth i found out the sex of the baby and he told me everything was fine he check the heartbeat butcould not hear one he said everything ws still okay!

you would need a medical malpractice lawsuit lawyer, which you can feel free to contact but i'm not sure you have a case. Even if your doctor had done and u/s and did not find the heartbeat, there would be nothign he could have done if they baby had already died. Granted, no doctor should send you home without checking so he was wrong in that.. but really there was nothing he could do. Did you find out the actual cause of death? I"m sorry for your loss :(

I too am sorry for your loss. Like others have said all the details aren't in the story so it is hard to pin the blame on someone. However, from what you did say I want to know what that doctor was thinking when he/she made out that prescription. That does seem like an awful lot of Valium to take each day so the pharmacist should have second guessed it, but ultimatly it was the doctor who prescribed it and who also approved the refill. The pharmacy would not have known anything about the previous suicide attempt. Those are all things that the doctor should have known about, whether or not he/she did know I don't know that. Many insurances will allow refills a few days early. However, if the original prescription was submitted through insurance for that quantity of 50 as a 10 day supply I am surprised that they didn't question that either. Many insurance companies have restrictions on the dosage/day, especially controlled substances such as Valium. If everything is really as you say it is I am surprised that lawyers wouldn't take you up on your case. Good luck!

I am so sorry about your loss. I can't think of anything more painful that anyone could endure. The loss of a child is such a serious trajedy. Let me tell you, I am a nurse and a mother of a little boy who almost died. He's suffered serious medical problems due to medical negligence and we live with it everyday. We are in the middle of a lawsuit. The type of lawyer that you would need is a "Medical Malpractice" lawyer. It sounds like the baby died after you saw the doctor, in which case, he would have had no way of knowing. It doesn't hurt to have your case reviewed. You can't tell for sure when the baby had died...teh specialist could be wrong. Your dr could have heard the heartbeat...you should have heard it as well. Its not wrongful death honey...its just a freak thing that happens. This is hard I know...but you need to try and move on...dragging it through the courts isn't going to make you feel better. You may want to see a counseller to help you get past it.

You can call every lawyer in the country, but you won't have a case to sue for wrongful death. Your doctor did not do anything wrong to cause the death, and therefore there is no case.

Wether or not the doctor knew anything was wrong doesn't give you the right to sue. I'm sorry this happened to you but no one caused your baby to die. You need to find a grief counselor not a lawyer.

i think that you should seek someone who only does wrongful death, and that will put forth 100% into your needs. they should have know that something was wrong if you had a apponitment 2 days before. why did they not tell you then , thats not normal.
