Im in love with the house I saw today. The location, the school, everything I want. But my lease for the apartment Im in is not done untill Nov. I havent talked to them about it. So I need some advice or suggestions. Pleeeaaasseeeeeeeeeee help me. Everything will fall through if the apartment people say no.

Usually you can get out of a lease if you can find an acceptable subleasor. Also, November isn't so far away. A reasonable landlord may let you out a month or 2 early if it means they have time to spruce up your apartment and put it back on the market when it's still warm out. November/December is NOT a landlord's favorite time to have an empty apartment because it means they're going to carry the unit without income through the holidays. Very few people move at the end of the year in most markets.

The other option you have is to ask the mortgage company to put off your first payment for a month or two after closing. FHA loans are allowed to defer the first payment up to 6 months. It depends on who your lender is and what type of loan you want to take out, but it is an option that you can discuss with your mortgage broker.

Talk to your landlord about breaking the lease. You most likely will lose your security deposit, but they may allow you to get out of the lease. A few things to consider before you do break the lease.

1) Are you sure that you can get the house? Do you have a contract on the property that has been accepted by the current owners? Are you approved for a mortgage?

2) What is the time frame that you are looking at until closing on the property? It usually takes at least 30 days from acceptance of a contract until closing.

3) Is the house vacant now, or will the occupants need to move, before you move in?

It is now August. Add the time you will need before closing and it will be well into September. You will have to stay in the apartment until at least September, so you will have to pay the rent for that month.

You will lose your security deposit if you break the lease., which will be equal to a months rent (October), and your lease is up in November. It seems to me that you would be better off not breaking the lease, and giving yourself time to fix up the new place (clean /paint) before you move your stuff in!!

Some states have statutes that allow you to break your lease if you are a first time home buyer.

Since your closing will more than likely be a month or two out, I would suggest talking to your landlord now about the situtation. They can discuss with you any repercussions you'll have by breaking your lease with them (forfeiting your deposit is standard on breaking a rental lease). You are going to need their approval anyway so it's best to give them as much of a notice as possible. Make sure to get whatever is agreed upon in writing too.

are you going to buy,or rent this house,do you have children.. Tell them you cant afford there apartment.and you have AL-most fallen be-hind ,you would like to know how you can move.with out being fined..if buying it would be October-November before you could actual . move in.
