I adopted him from my sister, but after the divorce will he still be legally my son?

I think you mean "stepmother" and not step wife, your wife and your son's step mother! If he's your sisters son{ you're his uncle by birth} and you adopted him, then you're his stepfather and legally he's yours. your wife is his stepmother because she is married to you! Are you asking if the courts can give him to her in a divorce, she's helped raised him as if "she" were his mother" and the courts make take that into consideration . You didn't mention the incident , but if it's causing you a divorce than it "must" be serious! It sounds like it's serious enough for you to be thinking that they might take him away from you? Does your sister see her son at all? Since she gave him up for adoption to you, I don't see "her" having any legal rights when it comes to your son either!{ i'm not sure on that} If you adopted him he'll always be legally yours no matter what you did, whether you have him or not!

legally adopted he is your son, as far as others having a right for visitation as in a regular divorce involvong kids....
Step parents can ask the court for visitation and a judge will take in to consderation if it will or will not benefit the child.
If you were never Legally married to the " step wife" the chances of them getting visitation are super slim as they never bothered to make it important enough to get legal.
I think we all need a better term for " step Wife"

never heard of a stepwife so not sure i could help ya.but if you mean she's the kids step mom then it would depend on if you adopted the child together or if it was just you

If your name is on the adoption papers as the father/primary caregiver of this child, he will always be your son. If her name is on the papers too, you may have to file for custody...

No, he will resort back to your sister who is presently your stepwife after the divorce is final.

The only way there would be a problem would be if your wife adopted him too. She could fight you for custody in that case.
