In case you don't know what it is, a person can be charged with murder if they kill a person unintentionally while committing a felony or attempting to do so.

The case of a girl beating up another and she died from athsma attack is actually a different matter of law dealing with causation.

No. Just because you broke into someone's house and they came home unexpected you shouldn't be allowed to kill them.

Actually, that is not felony murder -- but is close. Felony murder is when someone dies as a result of a different felony that you commit. It could be intentional, it could be unintentional and it could have nothing to do with you other than the fact that it results during your felony.

For example, suppose that you and a friend decide to rob a convenience store. You think that neither of you have weapons -- but your friend has a squirt-gun that looks real. As you are scooping cash out of the register, the cashier grabs a baseball bat. Your friend fires -- and you discover that it is a real gun. The cashier drops dead.

Your friend can be charged with murder. You can be charged with felony murder.

No -- I don't think it should be abolished. People need to take responsiblility for their actions.

No, I don't think it should be. I think it is horrible that a girl in our neck of the woods, beat up another girl, caused the girl getting beat up to have an asthma attack and die. The girl that unintentionally killed her only got 5 years probation. I think that was a very light sentence under the circumstances. The girls mother is appealing the case, and she fainted in the courtroom when she heard the verdict.

Absolutely not. People have to be accountable for ALL of their actions. If their actions cause another person to die while they are committing a felony, then THEY are responsible for that death and should be punished.

No.... it serves as a deterrent to crime... if somebody knows there is a chance they will get the needle it might dissuade them from attempting the crime in the first place (notice I said 'might') but without this deterrent in place crime would go up across the board, I believe.

In our country there is no such thing as felony murder.either its a murder(intentional) or homecide(unintentional).i don't think it should be abolished though.
