i thought they had to open diffent cases on each child

why not consult a free attorney. Once they staet gets involed they make there own rules. I hope she is prepared. I dont knoe the situation, but be ready!

This question is a bit confusing because it just is.

Are you saying that the child has been away from her for three years? If so, feel fortunate that the case is still open because I would be amazed that they haven't terminated her parental rights yet. CPS methods are very confusing, tricky and complicated. The rules change based on how the social worker is feeling that particular day. Fact is, if her child is still in foster care or what have you, they usually start the process of terminating rights at the 18 month point. The case may be open for a while but it looks to me as if your daughter better come up with a miracle and a good attorney or her rights are sure to be terminated. Good luck. Depends on what she did . If it was drugs ..she need to get into a rehab program . If it was neglect/ abuse . She need to take parenting classes ( parenting is required no matter what ) and go to counseling. I have had an open case since Jan 2005 . It's still open .Usually if nothing has been done by the mother to reunify with her kids by 16 months time , she will lose her rights as a mother ( california law ) . THERE IS ALWAYS A SOCIAL WORKER !! she needs to ask them what she needs to do and DO EVERYTHING THEY ASK !!!!!! don't bother putting up a fight against the system . Fight for your child.

Its simple all she has to do is prove she has a job a good living condition not using drugs and can care for the child in a safe environment. Then you file i forgot the exact number but you go to C.P.S to file the order and it usually takes a few weeks or so to get a resonse..G.L
