to a LIVE baby, then it's found dead, is she only charged with aggrivated manslaughter??? Sounds like MURDER to me!!!!

Of course it's murder!! She should be FRIED for that. I used to live in south Texas and it happened next door. The girl gave birth to the baby in the bathroom of her house while her whole family was home, put it in the trash can and her boyfriend put it in the dumpster of a CHURCH! She later went into the hospital for cramping and bleeding and tried to tell them she did not have a baby...WHAT AN IDIOT!! All because the baby's daddy was her best friend's boyfriend...do these people not understand...if you do not want the baby, you can take him to any hospital or police department and you will be charged with nothing?!?! There are THOUSANDS of people who can't have children and you throw this life AWAY?!?!

That is a good question. Probably because it is easier to prove manslaughter than murder. Most people could probably make a plea of manslaughter before they would murder. Less time too.

I agree w/most everyone else. Its murder. There are so many people who want but cant have a baby. There is absolutely no excuse for murdering a baby.

BTW, Kate I was reading one of your answers to a ? about marriage. I feel the same way you do. Maybe we can share some ideas on that. IM me if you want to exchange stories. I was just glad to know I wasnt alone.

Every case is treated individually. The District Attorney will only bring charges that s/he is reasonably sure that s/he can win, given the evidence that s/he has available. If there is ANY "reasonable doubt" as to what happened, then the D.A. will file lesser charges: It's that or lose the case and have the perp go entirely free! You wouldn't want THAT to happen, would you?
