Everything is negotiable. If you have not already signed an offer to purchase make that part of the agreement. If you have a home inspection and it is determined that the septic system needs pumping or repair, typically it should be a seller's expense.Your question leaves a lot for speculation since you have not disclosed where you are in the transaction. Is the negotiation in progress or has the sale been closed. If the transaction is closed the property has been accepted and there is no recourse for the buyer unless there was misrepresentation of material facts.

If you didn't go to contract yet, and this is only the house inspection, and the home inspection company finds anything wrong with the house, septic, termites/bugs/bats/radon, it is still the owners responsibly (not the interested party's). If, during the inspection stage, before the closing, there are problems with the place, you can negotiate a new price, minus the repairs, or the owner can agree to fix the problems. That's why it is very, very important to always have the house inspected! Buyer Beware!

IF you own the property now, it is too late to go back on the owner. YOur time for inspection was before closing. The owner did not know the tank needed pumping, and you have no way to prove you did not overload the system. IF this is a preclosing inspection, the owner pays. Good luck

Seems to me the new owner now owns the septic too, kind of like buying a used car. buyer beware, as is no warranty. But I don't know if there are any laws covering this or not
