Technically, a base runner must have his helmet on at all times, unless during the course of a play the helmet falls off due to unintentional efforts. You may not throw your helmet off. David Ortiz has made a habit of this during walk off home runs. If the ump chose, he could call him out for a uniform violation--he would be credited with a triple in the box score.

A baserunner may be called out for DELIBERATELY removing the helmet while the ball is in LIVE BALL TERRITORY and the ball is LIVE.
If you hit the ball out of the park, its a dead ball so the helmet can come off.
Throwing the helmet is not an automatic ejection. Throwing it IN ANGER is. Batters who KO for the 3rd out routinely throw the helmet towards the batboy.

If a base runner fails to keep his helmet on, the umpire will warn him to get the helmet on. If he does not comply with the umpire's request, he will be called out before the first pitch is made to the batter.

i think so as long as he's not throwing it at someone. they do it all the time when they hit walk-off homeruns and throw it off before they get to the plate.
